Privacy Policy

In our Privacy Policy, we inform you about the processing of personal data by Newil&Bau and Auratum Asunnot by Newil&Bau, including what data we process to provide our services. We understand the importance of data protection and always strive to protect your privacy and maintain your trust in us. We process data only to the extent necessary to provide our services to you, and we separate all identifiable information from the information we store, where possible. This Privacy Policy applies to all of our services, unless otherwise stated.

Please read this Privacy Policy carefully so that you understand how we process your personal data.

2. Definitions

“Account”, “user account” means your account registered through the N&B mobile application or the Newil&Bau website, for example the N&B Family account;

“Anonymized data” means data that has been processed in such a way that an individual can no longer be identified from it. Anonymized data is not considered personal data under data protection laws;

“Application” means (i) the Newil&Bau website and cloud service and (ii) the Newil&Bau mobile applications;

“Controller” means the natural or legal person, public authority or entity which, alone or jointly with others, determines the purposes and means of the processing of personal data;

“Cloud Service” means a service maintained by Newil&Bau to which the Newil&Bau web or mobile application is connected and with which it operates;

“Newil&Bau mobile application” or “N&B application” or “N&B App” means a mobile application or applications that (I) the user must download to their mobile device and (II) which is intended for the management of Newil&Bau apartments and/or housing company premises or for the management of related functionalities.

“Our website” means the websites at newilbau.fi, auratumasunnot.fi or the sales website of the housing property.

“Service” means Newil&Bau products, sales, customer service, support service, websites and/or applications and our communication with you;

“Personal data” means any information relating to an identified or identifiable natural person, such as a name or email address;

“Pseudonymised data” means data that has been processed in such a way that it can no longer be associated with a specific person without further information. Such additional information is carefully kept separate from personal data;

“Service desk” or “Customer service” means the system through which Newil&Bau processes customer service requests;

“Third parties” means any natural or legal person other than Newil&Bau or the primary user;

“Processor” means a natural or legal person, public authority or body that processes personal data on behalf of the controller.

3. Purpose and legal basis for processing personal data and data processed

Newil&Bau processes personal data in order to operate, sell, provide, improve, develop, understand, personalise, support and market its products and services.

The type of information we collect depends on how you use our services. We need certain personal data to provide you with our services, and the use of the services is not possible without your information. Our services may also include optional features that may require additional information to use. You will be notified separately about the processing of such information.

The processing of your personal data is based on the performance of the contract with us, compliance with our legal obligations, and the legitimate interests of Newil&Bau. Newil&Bau's legitimate interests include providing and developing our services, as well as sales and marketing, ensuring the functionality and security of our websites, and providing personalized content. Part of the processing of personal data is based on your consent, which we have specifically requested.

Information we process:

Personal and contact information

We process personal and contact information so that we can contact you and target communications to you about housing projects, the purchase of a housing project and housing-related services based on the information you have provided to us when creating an N&B Family account or when contacting us.

Information related to personal identification

When applying for financing or purchasing a home, we may need to request more detailed personal information to identify the person. The information collected in this context and the purposes for which it is processed will be explained separately.

Other information

We also collect other information from N&B Family members, such as the desired home locations and apartment types of housing projects that interest you, so that we can inform you about the housing projects you have provided based on the information. In addition to this information, we may also ask for other information so that we can better target information and marketing to you.

Customer information, customer support information and other communications

When you contact Newil&Bau sales, customer support, or otherwise communicate with us, we process your contact information and other information you provide. Based on the information you provide in this context, we can provide you with a better service or marketing that is targeted to you.

Automatically collected information

We process information collected from the use of our services, such as service, diagnostic, analytics and performance information. This includes, for example, information about your activities, such as how you use our services, your service settings, the time, frequency and duration of your activities and transactions, log information, as well as diagnostic, crash, website and performance logs and reports. This information is mainly anonymized or pseudonymized information and the analytics are not intended to be linked to identifiable personal data, but is used at a statistical level to develop and improve our services.

Cookies and analytics

We use cookies and analytics to operate, develop and provide our services, improve your experience, analyse the use of our services, target advertising and personalise our services. We also use cookies to remember your choices, such as your language selection or apartment-specific choices in N&B Studio.

Events, surveys, participation

When you participate in an event organised by Newil&Bau online or as a local event, we collect the necessary information to provide you with a good event experience. We may also collect information to improve the relevance of our event, but providing such information is voluntary. We also carry out various surveys or collect feedback either in connection with events or separately.

Information collected by the N&B application 

The N&B application is a service developed by inBliss Oy and distributed by Newil&Bau Oy. We collect information related to the distribution of the application using tools provided by the Apple App Store and Google Play. In order to function, the application requires the following information about its users: email address, name and the user's apartment. In addition to Newil&Bau staff, some of the application's data is also accessible to separately defined staff of the property management company and members of the housing company's board of directors, if so agreed.

4. Sources of personal data

The personal data we process originate from the person themselves. Some of the data is collected automatically from the use of our services, such as analytics and diagnostic data regarding the use of our services.

5. Is my personal data safe?

Newil&Bau is committed to protecting the privacy of all its users' personal data and to providing a safe, user-controlled environment for using the products in accordance with the European Union's General Data Protection Regulation (GDPR). You are also responsible for maintaining privacy and security, for example by prohibiting third parties from using your personal Account. Newil&Bau asks all users to take responsibility for protecting their identification data and to immediately notify Newil&Bau of any unauthorized use of their personal account.

6. Disclosure and transfer of data to third parties

We do not disclose personal data to third parties except in the situations described below.

We may also disclose your data if requested by authorities and if the investigation of suspected or actual illegal activity, ensuring the security of our services or protecting our rights requires disclosure of data.

Personal data may also be disclosed to third parties in connection with corporate transactions.

7. Transfer of data outside the EU

Newil&Bau processes your data within the EU.

8. Your rights

Newil&Bau complies with the requirements of Chapter III (Data subject rights) of the GDPR. They are summarized below.

Right to information. You have the right to receive information about the processing of your personal data.

Right to access data. You have the right to request access to your personal data that we process. You can access some of your data directly through our services.

Right to rectification and erasure, see also section 9. You have the right to ask us to rectify any inaccuracies in your personal data or to erase your personal data. You also have the right to receive your data in a structured, commonly used and machine-readable format and the right to transmit the data to another controller without hindrance from us, where the processing is based on your consent or the performance of a contract.

Right to withdraw consent and object to the processing of personal data. You have the right to withdraw your consent to the processing of your personal data at any time by notifying us in writing. The withdrawal of consent will not affect the processing of personal data before the withdrawal. Upon receive a notification, Newil&Bau will immediately stop processing your personal data. You can also ask us to stop using your personal data for marketing purposes. Please note, however, that, for example, our statutory obligations affect the exercise of the right to object. If separately stipulated conditions are met, you have the right to demand the restriction of the processing of your personal data.

9. Data retention and deletion

The N&B Family account will be deleted if it has not been used for 8 years. In other respects, the data retention period is based on the average apartment exchange period, which is 5-10 years. Commercial documents, contracts and customer management system data are not covered by N&B Family's data deletion.

You have the right to request the deletion of your data by writing to hello@newilbau.fi. In the event of deletion, your personal data will be deleted or anonymized, unless we have a legitimate reason or obligation to retain the data. After anonymization, you will not be able to access your data and it will no longer be possible to combine your personal data with other data.

10. Third-party websites or applications

Our application or website may contain links to services that we do not own or control, including social media sites, app store reviews or other similar services operated by third parties. We are not responsible for the privacy practices of third parties other than our third-party service providers or for the linked content. This Privacy Policy does not apply to these third-party websites or applications that are accessible from or mentioned in our Services.

11. Updates or changes to the Privacy Policy

We may change or update this Privacy Policy from time to time. If Newil&Bau uses your personal information in a manner that is materially different from that stated at the time of collection, we will notify you of such changes and ask you to review the revised privacy notice.
